General

The Sarda Email Singup Monthly Gift Card Giveaway will begin on the first of each month (commencing August 1st, 2025), at 12:01 am Pacific Standard Time (PST) and will end on the last business day of the respective month, at 11:59:59 pm PST (the"Giveaway Period"). The Giveaway will continue each month unless modified or terminated by the Sponser in Sponser's sole Discretion.

Before entering the giveaway, each entrant must review and agree to be bound by these Official Rules as set out below. By entering the Giveaway, entries accept and agree to be bound by the Official Rules, and accept the decisions of the Sponsor as final and binding in all respects.

Giveaway is sponsored by SARDA™ Inc (The "Sponsor"), 11819 100th Ave Ct E, Puyallup, WA, 98373, and is in no way sponsored, endorsed or administered by, or associated with any social media platform. Sponsor operates a handle or site including, without limitation, Facebook, Pinterest, Instagram, Youtube, and TikTok. All communication with respect to the Giveaway, including requests to be removed from future Giveaway mailings, should be directed to the Sponsor at the foregoing address (ATTN: Marketing Promotions).

Eligibility

The Giveaway is open only to legal residents of the United States who are at least eighteen (18) years of age or older by the date such person becomes a Member of the email list (as such terms are defined below). The Giveaway is void where prohibited or restricted by law. Anyone participating in the Giveaway or claiming a prize in the Giveaway in violation of these rules will be disqualified.

the Giveaway is not open to the following persons: employees, agent, or representatives of the Sponsor, the subsidiaries and affiliates of the Sponser, or employees, agents or representatives of suppliers providing prizes or other materials or services in connection with this Giveaway, including promotional agencies, (collectively, the "Excluded Individuals"); Immediate family members (parent, child, sibling and spouse of each) of the Included Individuals; and any other person with whom the Excluded Individuals reside.

How to enter; Selection of Winners

To enter the Giveaway, entrant must sign up to be a member of Sponsor's customer email list. At such time entrant becomes a Member is automatically entered into the monthly Giveaway.

Winner will be selected in a random drawing from all eligible Members during the Giveaway Period. The drawing will be held on or about the 5th day of the month following the Giveaway Period, by a representative of the Sponsor. There will be one (1) winner drawn from the eligible Members.

All entrants must become Members prior to the close of the Giveaway Period, and must not exit or unsubscribe from the email list prior to the close of the Giveaway Period. Limit of one (1) entry per person during the Giveaway Period. Anu person submitting more than one entry may be disqualified.

the Sponsor will notify potential winner by e-mail within five (5) business days of the drawing. In the event the Sponsor is unable to contact a potential winner by e-mail despite reasonable efforts to do so, as determined in the sponsors sole discretion, such potential winner's prize will be forfeited and an alternate winner may be chosen by Sponsor.

The e-mail notification will include a link that contains a copy of Release and Eligibility Agreement (the "Claim Form"), and other information required to claim the prize. all completed Claim Forms must be received by the Sponsor within five (5) business days of notification by Sponsor ("Submission Deadline"). Notification shall be deemed to occur when the e-mail notification is sent from Sponsor;s computer to the potential winner's e-mail address provided during the entry process. All completed Claim Forms become the property of the Sponsor. All Claim Forms will be verified by the Sponsor. In order to claim a prize, each potential winner must complete the Claim Form which includes representation of eligibility, compliance and releases of liability, and publicity release. among other things, the submission of Claim From confirms compliance with these rules, acceptance of the prize as awarded and release of certain parties from any losses, liabilities, damages or claims arising from or related to the prize awarded and the Giveaway itself. If potential winner fails to submit the Claim Form with all information required by the Submission Deadline, the Sponsor reserves the right to disqualify the potential winner, and the Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.

The winner must provide he or she is the qualified winner by presenting identification to the Sponsor (eg state driver's license; state issued identification card; acceptable valid passport with address verification; or birth certificate with social security card and photo identification and dress verification). If a winner cannot prove he or she is the qualified winner the prize will not be awarded. If winner declines the prize, another winner may be selected from the eligible entries received.

In the event of a dispute regarding the identity of the person submitting an entry, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry and the Members account associated with such e-mail. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Interest access provider, online service provider or other organization (eg business, educational institution, ect.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address and Member account associated with the winning entry.

Prizes/Value of Prizes

One (1) winner will receive one (1) $250 gift certificate for use online https://sarda.com. Additional terms and conditions may apply to use of the gift certificates. The approximate retail value of each prize is $250.

Prizes are awarded "as is" with no warranty or guarantee, either expressed or implied by Sponser. Winners may not substitute, assign or transfer Prize or redeem Prize for cash, but Sponser reserves the right, at its sole discretion, to substitute a Prize (or portion thereof) with one of comparable or greater value. Winner is responsible for all applicable federal, stae, and local and other tax liabilities, including but not limited to, sales and use taxes, excise taxes, income taxes; income and withholding taxes, customs duties, fees and like amounts in connection with a Prize. The Sponsor is not responsible for any such taxes or expenses. A Form 1099 may be submitted to all appropriate taxing authorities.

Odds of Winning

The overall approximate odds of winning depend on the number of eligible entries received and the number of Members during the applicable Giveaway Period.

For the names of the Giveaway winners to date in 2025, you may send a self-addressed, stamped envelope to the Sponsor, ATTN: Loyalty and Rewards Program Giveaway, 11819 100th Ave Ct E, Puyallup, WA 98373, for a list of winners.

Release; Consent to Use Likeness, Voice and Address

By entering the Giveaway, each winner agrees: (a) to abide by these rules and the decisions of the Sponsor, which shall be final and binding in all respects; (b) to release and hold harmless the Sponsor, its subsidiaries and affiliates of the Sponsor and the franchisees and affiliated merchants of each of the foregoing, all prize suppliers, all agents or representatives of the foregoing, including without limitation their advertising and promotional agencies, and each of their respective officers, directors and employees (collectively, the “Released Parties”) from any and all liabilities, liability, loss or damage arising with respect to the Giveaway or the awarding, receipt, possession and/or use or misuse of any Giveaway prize and further acknowledges that none of the foregoing persons have made nor are responsible or liable for any warranty, representation or guarantee a particular purpose thereto, prizes awarded may carry their own product warranty, for which the Released Parties have no responsibility for liability; and (c) to consent to the use of his or her name, image, voice, likeness, city and state of residence and/or photographs without compensation in any publicity or advertising carried out in any medium worldwide by the Sponsor and/or its advertising or promotional agencies without limitation or further notification, and without providing compensation or intellectual property rights to the Entrant, except where prohibited.

General Conditions

Entries that are incomplete, mutilated, altered, reproduced, forged, counterfeited or irregular in any way, are automatically void. The Released Parties are not responsible for the following: (a) lost, late, delayed, illegible, inaudible, stolen, damaged, altered, destroyed, mutilated, misdirected, illegal, incomplete or postage due rule requests, entries or prize claims; (b) lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software typographical, mechanical, telephonic, electronic or network relating to or in connection with this Giveaway, including, without limitation, errors which may occur in connection with the administration of the Giveaway, the processing of entries, the announcement of the prizes, or in any Giveaway-related materials; or any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in the Giveaway.

Entrants may be disqualified if automatic entry software is used in their favor or if Sponsor determines, in its sole discretion, that said Entrant tampered with the entry process or participated in, induced, or caused in any way any false, fraudulent, or improper entry, including, without limitation, offering prizes or other incentives to members of the public, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to select an alternate winner should the entries appear to have been tampered with or manipulated in any way.

Entrants may also be disqualified if the Sponsor learns that the entrant disparages the Sponsor during or after the Giveaway Period. Entrants should be aware that Sponsor reserves the right to take legal action against entrants who commit libel or slander against Sponsor during or after the Giveaway Period.

The Sponsor fully reserves the right, in its sole discretion, to cancel, suspend, terminate or modify the Giveaway if the Giveaway is not capable of being completed as planned, including infection by computer viruses or bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort beyond the reasonable control of the Sponsor, which corrupts or impairs the administration, security, fairness or proper play of this Giveaway.

The Sponsor is not responsible for printing errors in the Giveaway materials or these Official Rules and Regulations. If, due to a production or printing error or other unforeseen error, there are more winners than prizes for any level, the Sponsor reserves the right to award any remaining prizes for that level through a random drawing of all eligible winners for that level. No more than the number of prizes listed herein will be awarded.

No correspondence will be entered into except with potential winners.

By entering the Giveaway and voluntarily providing your personal information as described in these Official Rules and Regulations, you agree to the collection and use of your personal information by the Sponsor and its representatives, promotional agencies and marketing organization for the purpose of administering the Giveaway, Including without limitation contacting entrants in respect of the Giveaway and disclosing the list of winners. Your personal information may be used for future promotions and marketing of the Sponsor as described in Sponsor's Privacy Policy, a copy of which is available at http://www.sarda.com/policies/privacy-policy. If you would like to be excluded from all lists used by the Sponsor for any future promotions and marketing by the Sponsor, you may send a letter requesting that you be removed from such lists to the Sponsor at 11819 100th Ave Ct E, Puyallup, WA 98373, ATTN: Customer Service

This Giveaway and the terms and conditions contained in these Official Rules and Regulations shall be exclusively governed and constructed in accordance with the laws of the State of New York and the federal laws of the United States of America applicable therein. Any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusive jurisdiction and venue shall be in the state or federal courts located in Rochester, New York.

This Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited or restricted by law.

If any one or more provisions of these rules are held to be invalid, illegal or unenforceable by a court of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect the validity, effect or enforcement of any other provision or provisions of these rules.

From time to time, SARDA™ INC (“Promoter”) through its employees or management, may conduct contests, sweepstakes or giveaways (herein referred to as a “Giveaway”) on online platforms, including live/recorded broadcasts, including giveaways not previously announced (aka “Flash” or “Instant Giveaways”). By participating in a Giveaway, each entrant/contestant unconditionally accepts and agrees to comply with and abide by these “Official Rules,” including Promoter’s interpretation of these Official Rules, which shall be final and binding in all respects.

Promoter may, from time to time, conduct promotions, including sweepstakes, for which Promoter publishes specific rules. In the event there is a discrepancy or inconsistency between these Official Rules and the promotion-specific rules, the promotion-specific rules shall govern.

RULES

1. Eligibility. Individuals who are at least 18 years of age at the time of entry are eligible for entry into Giveaways. Employees, officers and directors of Promoter, its parent, affiliates, subsidiaries, advertising and promotion agencies, distributors and other prize suppliers (collectively with Promoter, the “Giveaway Entities”), and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to enter the Giveaway or win a prize. For purposes of this Giveaway, immediate family members are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children, and grandchildren, and those living in the same household shall mean people who share the same residence at least three (3) months a year, whether legally related or not. Entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. In the event of a dispute over the identity of an online entrant, the entry will be deemed submitted by the registered account holder of the email address associated with the entry or social media account for the domain associated with the submitted address.

2. Entering a Giveaway. Promoter will give instructions on how to enter each Giveaway by stating such instructions on online platforms or broadcasts depending on the online platform on which Promoter is implementing the Giveaway. The exact dates and method of entry for each Giveaway are referred to herein as the “Promotion Period.” A limit of 1 entry per person (regardless of method) will be accepted during each Promotion Period. Subsequent attempts made by the same individual to submit multiple entries by using multiple or false contact information, accounts or otherwise may result in the entrant being voided. Entries generated by a script, computer program, macro, programmed, robotic or other automated means are void and may be voided. Entries which do not follow all of the instructions, provide the required information in connection with entry, and abide by these Official Rules or other instructions of Promoter may be voided. Promoter assumes no responsibility for entrants not making timely entries as a result of delays in internet streaming or other technical delays and is not responsible for lost, late, damaged, stolen, misdirected, mutilated, or incomplete entries, regardless of cause. Information collected from entrants may be used by Promoter in accordance with, and subject to, Promoter’s Privacy Policy.

BY ENTERING THE GIVEAWAY AND ACCEPTING PRIZES/REWARDS, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE GIVEAWAY, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

3. Winner and Claiming Prizes. Giveaway winners will be determined according to the method specified by Promoter at Promoter’s sole and exclusive discretion. Decisions of Promoter as to the selection of the winner(s) will be final. The potential winner(s) will be notified using the information provided by the entrant in connection with entry, and such notification may be accomplished by email, telephone, mail, social media post (if entry is completed on a social media platform), or through a direct message on a social media platform (method to be selected by Promoter in its sole discretion), within a commercially reasonable time after the Promotion Period. Promoter is not responsible for false, incorrect, changed, incomplete or illegible contact information. Notification is deemed to have occurred (i) immediately upon notification by email, phone call, or via a social media platform, or (ii) three (3) days after mailing if notification is conducted by mail. If a potential winner cannot be contacted or does not respond to claim his or her prize within FIVE (5) business days after the contest winner(s) are announce, he or she will be disqualified. In the event a prize goes unclaimed, Promoter reserves the right to announce an alternate winner by the same terms the contest was previously run, or select a winner in their own discretion, or cancel the contest.

Promoter is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s email account to receive email messages. Each potential winner may be required to submit an affidavit of eligibility / release of liability / prize acceptance agreement (collectively, the “Affidavit”) and return the Affidavit within the time period specified at notification before being eligible to receive his or her prize(s). If any potential prize winner fails or refuses to sign and return such Affidavit within the time period required by Sponsor, or if the prize or prize notification is returned as rejected, faulty, unclaimed or returned as undeliverable to such potential prize winner, such potential prize winner may be disqualified and an alternate may be selected. The winner(s) may also be required to provide Sponsor with a valid social security number for tax reporting purposes before the prize(s) will be awarded. An IRS Form 1099 may be issued in the name of winner(s), or if a minor in the jurisdiction in which he or she resides, in the name of his/her parent or legal guardian, for the actual value of the prize(s) received.

4. Prize(s) and Values.

Prize(s) are non-transferable, have no cash value and shall have no cash redemptions, equivalents, or substitutions, except at Promoter’s sole and absolute discretion. Promoter reserves the right to substitute a prize of equal or greater value. All prize details not specified in these Official Rules and the applicable Giveaway advertisement will be determined in Promoter’s sole and absolute discretion. All prize(s) are awarded “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Winners are responsible for all applicable federal, state, provincial, municipal and local taxes and all other costs and expenses associated with prizes. Promoter may in their sole, absolute discretion limit the prizes awarded to previous winners within the last twelve months. The odds of winning a prize depend on the number of eligible entries received.

5. Publicity Release; License. Subject to applicable law, by accepting a prize, winner(s) irrevocably grant Promoter and its affiliates, successors, assigns and sub-licensees the right and permission to use their name, voice, likeness and/or biographical material for advertising, promotional and/or publicity purposes in connection with the Giveaway, in all forms of media and by all manners (now and hereafter known), and in connection with products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation or, notice.

All entrants submitting materials/content as part of a Giveaway entry shall be deemed to grant to Promoter a non-exclusive, royalty-free, worldwide license (with the unlimited right to sublicense) to use such materials, and the images related thereto (including entrant’s name, social media account username and likeness), for any purpose (including any and all commercial purposes), with the right to modify the materials and make derivative works thereof, without any further consideration to the entrant. Entrant represents and warrants that the materials submitted will not infringe or violate any right whatsoever, including, without limitation, any personal rights (e.g., defamation, privacy, false light, moral right, etc.) or any property rights (e.g., copyright, trademark, right to ideas, etc.) of any person or entity, and the use thereof will not result in any third party liability or obligations. Promoter reserves the right to reject any content, in Promoter’s sole discretion, based on the operating practices and policies established by Promoter and the terms set forth herein.

6. Termination. In the event Promoter is prevented from continuing with a Giveaway by any event beyond its control, Promoter shall have the right to modify, suspend or terminate the Giveaway or prize. Promoter additionally reserves the right, in its sole and absolute discretion, to modify, suspend or terminate the Giveaway should causes beyond Promoter’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Giveaway.

7. Waivers, Disclaimers and Releases. By participating in the Giveaway, entrant hereby releases, indemnifies, and holds harmless Promoter and its directors, officers, employees, agents, successors and assigns (“Released Parties”) from and against any and all claims, liability, costs (including attorneys’ fees), losses, damages, fines or injuries of any kind arising out of or related to: (i) entrants’ participation in the Giveaway (including travel to/from any Giveaway activity); or (ii) any acceptance, possession, misuse or use of any prize (including, without limitation, losses, damages or injuries to entrant’s or any other person’s equipment or other property, or to their persons, including those arising from any travel to/from any prize event or activity). Entrant agrees that the Released Parties shall have no responsibility or liability for any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects; and/or any other errors or technical malfunctions of any kind.

8. Governing Law / Limitation of Liability. All disputes concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the parties in connection with the Giveaway will be governed by and construed in accordance with the internal laws of the State of Washington, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

9. Miscellaneous. The invalidity or unenforceability of any provision of these Official Rules or the Affidavit will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the Affidavit is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in Promoter’s Privacy Policy or terms of use on any website, social media platform or application and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Promoter’s sole and absolute discretion.
